Cannon System Design Contractually Binding Cancellation Policy

Thank you for choosing Cannon System Design for your technology and AV needs. We are committed to providing exceptional service. To maintain fairness and clarity, the following outlines our legally binding cancellation policy. By entering into any agreement with Cannon System Design, you agree to the following terms and conditions, which constitute an integral part of the contract between you (the "Client") and Cannon System Design (the "Company").

  1. Cancellation Within the First 30 Days (No Work Performed):

    • If a cancellation request is made within the first 30 days and no work has been performed, the Company will retain 30% of the total payment as a restocking fee for all parts.

    • Any deposits paid shall be non-refundable and will be retained by the Company as liquidated damages.

  2. Cancellation After 30 Days or If Work Has Been Performed:

    • If the cancellation occurs after 30 days or work has commenced, the following terms shall apply:

      • If 50% or less of the contract term has been completed: The Client shall be responsible for paying 50% of the total contract value as a cancellation fee.

      • If more than 50% of the contract term has been completed: The Client shall be required to pay the equivalent of one additional month’s payment beyond the effective cancellation date, in addition to any other amounts due under the agreement.

  3. General Provisions:

    • Cancellation requests must be submitted in writing to [insert company email address] or mailed to the Company’s principal business address at 5801 Golden Triangle Blvd, Suite 103 MB-252, Fort Worth, Texas 76244. Verbal cancellations will not be accepted.

    • The cancellation shall only become effective upon confirmation of receipt by the Company.

    • Refunds, if applicable, will be processed within 30 business days after the effective cancellation date, allowing the Company sufficient time to attempt to return equipment to manufacturers and recoup costs, where applicable.

    • The Client expressly agrees that failure to adhere to the cancellation procedure will result in the forfeiture of any refund rights.

    • Any legal agreements entered into with any parent company of Cannon System Design or HostMy.com shall be governed by and subject to the same terms and conditions outlined in this policy.

  4. Special Considerations:

    • Customized or specially ordered parts are strictly non-refundable and non-cancellable once the order has been placed.

    • Any work performed prior to the effective cancellation date, including but not limited to planning, design, or installation, shall be invoiced at the Company’s standard hourly rate and shall remain due and payable by the Client in addition to any cancellation fees.

  5. Legal and Binding Nature of Agreement:

    • This policy forms part of the binding agreement between the Client and the Company. By engaging the services of Cannon System Design, the Client acknowledges and agrees to the terms contained herein.

    • This policy shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under this policy or the related agreement shall be resolved exclusively in the courts located in Tarrant County, Texas.

  6. Force Majeure:

    • The Company shall not be held liable for delays or cancellations caused by events beyond its reasonable control, including but not limited to acts of God, governmental actions, labor disputes, or supply chain disruptions.
